We’re stepping up to North Dakota. Here’s why.

Back in August 2019, the legislators of North Dakota felt it was within their power to violate your constitutional right of free speech. They enacted a law that made it illegal for you to display a phone number other than your own – even though Congress had already decided that it was legal for you to do so – and made it possible for you to be criminally prosecuted for changing the number. 

After monitoring the bill closely and attempting to work with the legislators of North Dakota, our efforts fell on deaf ears. They chose to enact the bill, without recognizing the impact it would have on your individual freedom. We were left with no other option than to act, so we did. We drafted a complaint addressing our concerns and filed it with the U.S. District Court in North Dakota. 

While we support the efforts of stopping illegal spoofing, we cannot support the efforts of a state government prohibiting your ability to protect yourself and your personally-identifying information. We have been privileged to live in a country that for over 200 years has prided itself on allowing its citizens to pursue the right to life, liberty, and the pursuit of happiness. This bill not only takes away your liberty to protect your number, but it also endangers millions of Americans who may accidentally break this new law. How? This law makes it possible for someone outside of North Dakota to be prosecuted with fines and jail time, if they call someone located in North Dakota. Let’s say for instance you call someone with a California area code and display a different caller ID to protect your personal information. If that individual happens to be in North Dakota when you call, they now have the right to sue you and prosecute you for calling them. Not only is your freedom being taken away whether or not you live in North Dakota, but now millions of Americans could potentially be at risk every time they call someone whether or not that individual resides in North Dakota.
